Addendum
Breach of Restrictive covenants:
To our knowledge, it is likely that clause 2 of the Third Schedule of the 1938 Conveyance has been breached given that there are windows, doors or openings on all sides of the property, but the Whitley Beaumont Estates are yet to enforce any breach. There are a number of Council owned and ex Council owned properties now built between the Property and the Retained Land of the Whitley Beaumont Estates and it is therefore believed that any attempt to enforce the breach would be seen as too remote to be
successful. The clause also provides that if windows, doors or openings are used contrary to the clause, no rights shall be gained. This appears to have been drafted in anticipation of a breach. We would however recommend that you obtain your own legal advice on this.

Lease noted on Title Register:
A lease for the property is noted within the Charges register for a term of 15 years from 31.03.1995. As referred to in the CPSE's, the tenants vacated the property in 2022 and
surrendered their leasehold interest at this time. An application has been made to the Land Registry for removal of this entry from the Register of Title.
